Terms of Sale

1. Purpose
These Terms of Sale govern the sale of personalized photo frames made through the Cadrily website by [Prénom NOM à compléter], a sole proprietorship registered under Crossroads Bank for Enterprises (BCE) number [BE0XXX.XXX.XXX à compléter] (hereinafter "Cadrily" or "the seller"). Placing an order on the site implies the customer's unreserved acceptance of these Terms of Sale.
2. Products
Cadrily offers personalized photo frames, made from a photo uploaded by the customer and a style chosen by them. Each frame is made to order, specifically for the customer, and is not held in stock.
3. Prices
Prices are shown in euros (EUR), all taxes included (Belgian VAT included). Three sizes are available:
- Small (15 × 20 cm) — €29.00
- Medium (30 × 40 cm) — €49.00
- Large (45 × 60 cm) — €79.00
A fixed delivery fee of €10.00 is added to the price of the selected frame and is shown before the order is finally confirmed. Cadrily reserves the right to change its prices at any time; the price applied is the one in effect at the time the order is confirmed.
4. Order
The customer selects a style, uploads a photo, personalizes their frame, then confirms their order after entering their delivery details. The order is only final once payment has been confirmed.
5. Payment
Payment is made online, in a single instalment, at the time of ordering, by credit/debit card via the secure Stripe platform. Cadrily never has access to the customer's banking details, which are processed directly by Stripe.
The order is only sent into production once payment has been confirmed by Stripe.
6. Delivery
Cadrily delivers exclusively within Belgium. Production and shipping are handled by a third-party print provider. Production and delivery times are given for guidance at the time of ordering and may vary depending on the size chosen.
The customer is solely responsible for the accuracy of the delivery address provided. Cadrily cannot be held liable for any delay or failed delivery resulting from an incorrect or incomplete address.
7. Warranties
Cadrily does not offer any commercial warranty beyond the legal warranties applicable in Belgium, including the legal warranty of conformity for hidden defects. In the event of a manufacturing defect (product damaged on arrival, printing error attributable to Cadrily), please contact us at the address given in the Legal Notice so that a solution can be considered on a case-by-case basis.
8. No right of withdrawal — personalized products
In accordance with Article VI.53, 3° of the Belgian Code of Economic Law (transposing Article 16 of Directive 2011/83/EU), the right of withdrawal does not apply to contracts for the supply of goods made to the consumer's specifications or clearly personalized.
As every Cadrily frame is made from a photo and a style chosen individually by the customer, orders are therefore not eligible for any right of withdrawal and cannot be returned or refunded once confirmed, except in the case of a manufacturing defect attributable to Cadrily (see Article 7).
9. Liability
The customer is solely responsible for the content of the photos they upload and warrants that they hold the necessary rights to reproduce them. Cadrily reserves the right to refuse any order whose content is manifestly unlawful.
10. Governing law and disputes
These Terms of Sale are governed by Belgian law. In the event of a dispute, an amicable solution will be sought first, before any legal action. Failing an amicable agreement, the competent Belgian courts shall have sole jurisdiction.
